A Restriction In The Deed To Rippling River
The quick answer is that the property (Federal Project No. CAL 33-9) was transferred by the Federal Government to the Monterey County Housing Authority (not an arm of the County of Monterey) in 1980, and the property is currently restricted by a 40 year Deed restriction (good through July 2020) that requires the property to be made available for federal section 8 housing participants ((Reel 1421, Page 1194).
The property is also restricted by a separate Trust agreement with the Federal Government for the use as low income rental housing containing 79 units, with applicability until the notes are paid off, in accordance with the annual contribution contract with the Federal Government (Reel 1421, page 1200).
The latter also prohibits the property from being otherwise transferred, sold, or utilized for anything but low income housing during the term of the trust (Reel 1421, page1203). The Federal Government, the residents, and holders of Section 8 housing certificates may enforce the Deed and the Trust as a matter of right.
